Terms & Conditions of Sale

1. Seller identification

This website is operated by FENS S.R.L. (an Italian limited liability company), registered office at Via Friuli 1, 06034 Foligno (PG), Italia, VAT number 03653330542, tax code 03653330542, Umbria Companies Register no. 03653330542, REA PG-304659, share capital €10.000 fully paid up, email info@dirosetta.com, certified email (PEC) fens@pec.it (also referred to as “Rosetta”).

Operational address for shipping and returns: Via Monte di Pale 1, 06034 Foligno (PG), Italia. This address is not the registered office.

2. Scope

These terms apply to all distance sales contracts concluded through this website between the seller and the customer. Where the customer acts for purposes outside their trade, business, craft or profession, the protections of the Italian Consumer Code (Legislative Decree 206/2005) and of EU distance-selling law also apply.

3. Product characteristics

The products are accessories made in small quantities. Images and descriptions aim to represent them as faithfully as possible; slight differences in colour, finish or measurement may result from handcrafting and from your screen settings, and do not constitute a lack of conformity.

4. Availability and stock

Availability shown on the site is accurate at the time of consultation. If a product turns out to be unavailable after your order is placed, we will inform you promptly and refund any amount already charged, at no cost to you.

5. Prices

All prices shown on the site are in Euro and include VAT. We add no further tax at payment. Shipping costs, where due, are shown separately before the order is placed. For deliveries outside the European Union, import duties, taxes and local charges may still be requested by the destination country, as set out in clause 9.

We reserve the right to correct manifest pricing errors, informing you before the order is fulfilled and leaving you free to confirm or cancel it at no cost.

6. Placing an order

The contract is concluded when, after reviewing the cart summary, the delivery address and the total including shipping, you submit your order and complete payment. Submitting an order implies acceptance of these terms.

7. Payments

Payments are processed by Stripe Payments Europe, Ltd. and Stripe group companies. Major credit and debit cards are accepted, along with any further methods offered at checkout. Full card details are handled directly by Stripe: the seller has no access to them and does not store them.

8. Order confirmation

Once payment succeeds you receive a confirmation email with your order number and a summary of the purchase. If payment fails or is abandoned, the order has no effect and no amount is charged.

9. Shipping

We ship to Italy, to European Union countries and to a selection of international destinations. Shipping costs €7 in Italy (free from €120) and €15 within the European Union (free from €150). Rates and thresholds for other destinations are listed on the Shipping & Returns page and at checkout.

Orders shipped outside the European Union travel on DAP terms: import duties, taxes or local charges collected in the destination country may be charged separately to the recipient. Collection in person is not available. The carrier may vary depending on the destination. Full details are on the Shipping & Returns page.

10. Preparation times

Every order is prepared within 10 working days. Carrier delivery times are additional to preparation times: approximately 2–5 working days in Italy and 4–10 working days within the European Union.

11. Right of withdrawal

If you are a consumer, you have the right to withdraw from the contract within 14 days of delivery, without giving a reason. You must communicate your decision within that period by writing to info@dirosetta.com. The procedure and the model form are described on the Right of Withdrawal page.

12. Returns

The product must be returned within 14 days of communicating your withdrawal: unused, unwashed, undamaged, with no stains, odours, deformation or signs of wear, and complete with its original packaging, tags and accessories. Return shipping costs are borne by the customer, except where the product is defective, damaged or the wrong item was sent by us.

13. Defective or non-conforming products

If the product you receive is defective or does not match your order, write to info@dirosetta.com with your order number and, if possible, photographs. We will arrange replacement, repair or refund as provided by law, with return shipping at our expense.

14. Refunds

Refunds are issued within the time limits set by applicable law, using a means of payment compatible with the one used for the purchase, at no additional cost to you. In the case of withdrawal, the refund may be withheld until we receive the product or you provide proof of its dispatch, whichever is earlier.

15. Legal guarantee of conformity

Consumers benefit from the legal guarantee of conformity under Articles 128 et seq. of the Italian Consumer Code, implementing Directive (EU) 2019/771: the seller is liable for lack of conformity that becomes apparent within 24 months of delivery. The consumer may request repair or replacement and, under the conditions set by law, a price reduction or termination of the contract. We do not offer any commercial guarantee in addition to the legal one.

16. Liability

We are liable for failure to perform our contractual obligations in accordance with the law. Nothing in these terms limits or excludes liability for wilful misconduct, gross negligence, personal injury, or the mandatory rights granted to consumers. We are not liable for disruptions beyond our control, such as force majeure or unforeseeable carrier delays.

17. Intellectual property

Trademarks, names, texts, photographs, illustrations and all other content on the site belong to the seller or to their respective owners and are protected by copyright and trademark law. Reproduction or use without written authorisation is prohibited.

18. Governing law

Contracts concluded through the site are governed by Italian law. If the customer is a consumer resident in another EU Member State, the more favourable mandatory provisions of the law of their country of habitual residence continue to apply.

19. Dispute resolution

For any complaint, please write to us first at info@dirosetta.com: we always look for a direct solution. Your statutory remedies remain unaffected, including recourse to the competent mediation and alternative dispute resolution bodies. For court proceedings, the competent court is that of the consumer's place of residence or elected domicile.
